What is a foreclosure?

It is a legal process in which lender obtains the right to sell the mortgaged property of borrower to recover the loan amount and other claimed amount. Normally this happened due to poor management of funds. The legal agreement between borrower and lender bounded borrower to pay regular installments. If borrower failed to pay installments in time, then lender holds the right to go for foreclosure. The time frame for lender to go for foreclosure depend upon various conditions and also on state law as well. Most lenders doesn’t allow borrower to delay the payable amount for more than 90 days. some allow borrower to delay the payment for 30 days but after that lender contact court of law to use the right of foreclosure.

After obtaining the right for foreclosure, lender contact borrower for the resolution of problem as a last chance. All depend on negotiation but lender is in a position to accept these negotiations conditions or refused it.

If negotiation process if failed then lender go for auction. All the charges borne by lender will recover for the proceed of auction. Court of law or consumer court (base on state law) appointed a person who conduct auction, keeping the both parties interest save. The proceed from auction are subject to 10% or the percentage as define by court of law, forward to court of law and remaining amount will use to satisfied the debt of borrower. The remaining of the proceeds will handed over to borrower. It is observed in some cases that borrower who obtained 80% debt ratio mortgage loan failed to pay the due amount to lender. This happened due to higher amount of loan and charges. That time, court of law decided the solution. Lender then of course hold the right to go for a criminal court to recover the remaining amount if pending after auction.

There are different organizations that helped peoples in foreclosures. There are some financial institutions who granted loans of people in foreclosure.
